Terms of Service

1. Acceptance of Terms

By downloading, installing, or using OBDAssistant ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

OBDAssistant is a mobile application that connects to your vehicle's OBD2 diagnostic port via a Bluetooth adapter to:

• Read and interpret diagnostic trouble codes (DTCs)
• Stream live sensor data from your vehicle's electronic control units
• Provide AI-powered analysis and repair suggestions
• Measure vehicle performance (acceleration, braking, dyno estimation)
• Contribute anonymized data to the global OBD Health Index

3. User Responsibilities

You agree to:

• Use the App only while the vehicle is safely parked or with a passenger operating the App
• Not rely solely on the App for safety-critical decisions about your vehicle
• Ensure your OBD2 adapter is compatible and properly connected
• Not attempt to reverse-engineer, decompile, or modify the App
• Not use the App to perform unauthorized modifications to vehicle systems

4. Read-Only Access

OBDAssistant operates in read-only mode. The App reads data from your vehicle's diagnostic system but does not write to, modify, or re-program any electronic control unit (ECU). The App cannot alter your vehicle's operation in any way.

5. AI-Generated Content

The App uses artificial intelligence to analyze diagnostic data and provide suggestions. AI-generated content is provided for informational purposes only and may contain errors or inaccuracies. You should:

• Verify AI suggestions with a qualified mechanic before acting on them
• Understand that AI analysis is based on pattern recognition and may not account for unique vehicle conditions
• Not rely on AI-generated tune tables or modifications without professional verification

6. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your diagnostic data. By using the App, you consent to the data practices described in our Privacy Policy.

7. Intellectual Property

All content, features, and functionality of OBDAssistant — including but not limited to the user interface, AI models, data visualizations, OBD Index, and underlying software — are the exclusive property of OBDAssistant and are protected by international copyright, trademark, and other intellectual property laws.

8. Service Modifications

We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• OBDAssistant is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not warrant that the App will be error-free, uninterrupted, or free of harmful components
• We are not liable for any damage to your vehicle, property, or person arising from the use of the App or reliance on its diagnostic information
• Our total liability shall not exceed the amount you paid for the App

10. Indemnification

You agree to indemnify and hold harmless OBDAssistant and its operators from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately.
